THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES.  THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT(S) WILL BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP.

TO THE EXTENT NOT PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. EXCEPT FOR THE EXPRESS WARRANTIES CONTAINED IN THIS LIMITED WARRANTY STATEMENT AND TO THE EXTENT NOT PROHIBITED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR JURISDICTION, WE LIMIT THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO PRODUCT REPLACEMENT, REPAIR OR REFUND OF PURCHASE PRICE, AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.


WHO MAY USE THIS WARRANTY?

Rodon Limited Partnership (“Rodon”), located at 2800 Sterling Drive, Hatfield, Pennsylvania 19440, provides this 15-year limited warranty to the initial purchaser of plastic molded products manufactured by Rodon (hereinafter referred to as, the “Products”).  This limited warranty may be enforced by only the party who is the initial purchaser of Products manufactured and sold by Rodon.  This limited warranty is not transferable.

WHAT DOES THIS WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of the Product(s) for a period of fifteen (15) years from the date of purchase.  More specifically, Rodon warrants that its standard Products will conform to Rodon’s published product specifications, and custom Products will conform to the product specifications provided by the relevant customer. 

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage, product failure or poor product performance due to: (a) normalwear and tear; (b) transportation; (c) storage; (d) misuse, abuse or failure to properly provide maintenance; (e) improper installation not in conformance with Rodon’s catalog or application drawings or instructions; (f) alternations or modifications; (g) unauthorized repair; (h) external causes such as accidents, abuse, fire, lightning, hurricane, high winds, or other actions or events beyond Rodon’s reasonable control; (i) the negligence, gross negligence or willful misconduct of any third party; (j) vandalism or attack by any party; (k) defects in the structure or a component of the structure (i.e., window, door or wall system) or selection and use of incompatible and/or inappropriate components which negatively affect the performance of the Product(s); (l) contamination from, or exposure to, chemicals; (m) nonstandard use or application of the Product(s); (n) foreign objects or agents, including the use of materials incompatible with the Product(s); and/or (o) the reuse of the Product(s) in a second installation.

Rodon does not control the end use of its Products, and you (i.e., the purchaser-our Customer), are, therefore, responsible for fully testing the suitability of our Products under extreme actual field use conditions, for your or your customers’ reasonably expected end use of the Products.

Discovery of, and protection from, any and all intellectual property infringement, arising from the component end use of any custom Products manufactured by Rodon, is your responsibility (our Customer).   

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date of the initial purchaser’s purchase of the Product(s) and lasts for fifteen (15) years (the “Warranty Period”).  The Warranty Period is not extended if Rodon replaces the Product.  Rodon may change the availability of this limited warranty at its discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

If any Product manufactured by Rodon is found to be defective by Rodon, in its sole judgment, Rodon will, at its option either repair or replace with the same or substantially equivalent replacement for such defective product, or refund the purchase price.  Custom or non-standard colors and/or finishes that are determined to require service may be substituted with a similar color or finish at Rodon’s discretion if the color or finish is no longer available.  Any repaired or replaced Product is covered only for the remainder of the warranty period.  The Warrantee must reasonably cooperate with Rodon or its representatives in their efforts to perform their obligations under this Warranty. 

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must promptly email Rodon’s Customer Service Department at sales@rodongroup.com during the Warranty Period to report any potential claim, no later than thirty (30) days after you discover the potential claim.  The following information must be submitted with the warranty claim: (1) name and address of claimant; (2) product number (if applicable) and description of the Product(s); (3) proof of purchase; and (4) description of the problem or defect.  At Rodon’s request, you must provide Rodon or its representatives with a reasonable opportunity to inspect and/or test the Product(s) to determine whether or not the Rodon Product(s) failed as set forth herein. 

Rodon will advise the purchaser of its position with respect to the warranty claim.  In the event a Product is to be returned to Rodon under this limited warranty, the Product returned must be suitably packed.  Upon receipt of the Product and determination by Rodon that this Limited Warranty applies, Rodon will perform the warranty repair, or replace the Product, or refund the purchase price for the Product, as required in accordance with this Limited Warranty.  Any Product that is repaired or replaced will be returned to the initial purchaser freight collect.  All Products replaced or for which the purchase price has been refunded become the property of Rodon.

LIMITATION OF LIABILITY

THIS LIMITED WARRANTY IS EXCLUSIVE.  RODON MAKES NO OTHER WARRANTY OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS MANUFACTURED AND SOLD BY IT, WHETHER AS TO ANY WARRANTY OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER MATTER.

RODON’S LIABILITY IS LIMITED ONLY TO THE REPLACEMENT VALUE OF THE PRODUCT.  RODON SHALL NOT IN ANY EVENT BE LIABLE TO ANY BUYER FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL OR SPECIAL/PUNITIVE DAMAGES OF ANY KIND, OR FOR THE LABOR CHARGES WHICH MAY BE REQUIRED FOR THE REMOVAL, REPLACEMENT OR REINSTALLATION OF SAID PRODUCT, WHETHER FOR BREACH OF WARRANTY, NEGLIGENCE, ON THE BASIS OF STRICT LIABILITY, OR FOR ANY OTHER REASON.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

The purpose of this exclusive remedy shall be to provide initial purchaser with repair and replacement of Products manufactured by Rodon found to be defective in materials or workmanship or negligently manufactured.  This exclusive remedy shall not be deemed to have failed of its essential purpose as long as Rodon is willing and able to repair or replace said defective products in the prescribed manner.

The foregoing is the only Warranty made by Rodon for Rodon Products.  No representative, dealer or any other person is authorized to make, or makes, any warranty, representation or promise on behalf of Rodon with respect to Rodon Products.  No terms or conditions other than those stated herein or provided by law, and no agreement or understanding, oral or written, in any way purporting to modify this Warranty shall be binding upon Rodon unless made in writing and signed by an authorized representative of Rodon.

THIS WARRANTY IS NOT A PERFORMANCE CLAIM.

THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES.

GOVERNING LAW/VENUE

This Limited Warranty shall in all respects be governed by the laws of the Commonwealth of Pennsylvania.  Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, this Limited Warranty shall be brought against any of the parties in the federal or state courts located in Montgomery County, Pennsylvania, and each of the parties consent to the jurisdiction of such courts in any such action or proceeding and waives any objection to such venue.

This Limited Warranty Policy is effective as of November 12, 2019.
